What is the name of your state? What is the name of your state? Ohio
two years ago my husband and i filed a lawsuit against the builder of our house for a number of things such as breech of contract negligence shody workmanship and there were 2 others.
two weeks before this past christmas we had to leave our house because of our sons health. he developed asthma and he has an allergy to mold which the house is infested with. therfore he was suffering all the time and we also had a new baby (didn't want anything to happen to her)so we left. now our credit is snowballing and it seems our attorney is a little on the laid back side. the company we are suing keeps turning things around to blame the sub contractors they hired and its turned into 3 rd party lawsuits. are they allowed to do that? also we have a 42 page report from a civil engineer explaining everything that is wrong with the house and the building codes they violated. it has been forwarded on to all other attorneys. now one is asking to have their own done do we have to allow that?and my last question is can we file for bankruptcy or will that ruin the lawsuit. (we have been served forclosure papers)

**A: so where is your attorney now and what has he/she done since? Maybe you need to replace that attorney with a proactive sob pitbull type one.

our attorney is "working " on the case but it seems to us that he needs to get alittle more demanding about what we want and put an end to this. to top it all our good credit has gone down the tubes. looking to file bankruptcy to get a fresh start because there is no way we will be able to pay off debts with a apr of 27.00%. contacted creditors all they can do is put our apr back to where it was for only 4 mos. we aren't real sure about the time frames or what is or isn't normal in a lawsuit like this. we really don't know what to do. we have about 10,000.00 in our attorney.

**A: start talking to other attorney's. The one you have is too slow.
Check out www.hadd.com regarding problem builders.

Wrong attorney

I need to start by saying you might have the wrong attorney! You have a mold issue and this needs to be addressed by a certified trial lawyer. he needs to have expertise in Toxic mold and remediation. I am a certified mold investigator and work with some of the biggest firms dealing in mold lidigation resulting from contruction defects. Two years of this with out immediate health evaluatin and continuos monitoring to dertermine any medical problem arising from your continous exsposure to toxic mold should have been #1.

Has anyone done any mold testing to find out what type of mold your were exsposed too? That is very inportant mold id very toxic to children. With regard to your morgage you need immediat relief from morgage constraints without penalty. To much money and so littlew results a red flag stands up here. Please feel free to e-mail me so I can send you more info on mold. Good luck.
