In CA. how long can a general contr. hold a subcontractor's progress payment after he has been paid by the owner?

It depends on the terms of your contract with the General and if there is any state law. You need to become familar with the time limits on filing leins if you need to go that route. A local construction association like AGC or ABC normally can provide you with this information or you can consult with an attorney.

its not your problem, you have a contract with the general and the subs have a contract with the general NOT you!

Hey Senior Judge: Can you clarify?

here in arizona, While all the various parties ask and get lien wavers they dont really mean anything. Why? because if you contract with the General Contractor, A sub-contractor (say the tile setter) cant lien your house because the sub has never contracted with the owner of the property. The Sub has a contract with the General Contractor not the Owner. Does that make sense?

I have no idea what the lien laws are in your state.

Anyway, in my state, a few years ago they had a big flap because subs figured out how to file liens even if gen was paid. The legislature put a stop to that.
