HVAC guy cashed our check - but no work or equipment!

What is the name of your state (only U.S. law)? PA

Can we file a criminal complaint against a person who we paid a deposit to based on a contract to purchase equipment and install a central air conditioning unit - they cashed our check and they are giving us a run around on whether or not they even have the equipment - we found out their property was foreclosed on recently and is supposed to be up for sheriff's sale August 4th, plus they have multiple other lawsuits against them for other judgements...How can we prove that they never purchased the equipment with our money?

We have filed a civil suit in small claims court today.

Contact your Local Office of Attorney General-Consumer Affairs .

Ask if they have similar complaints on the contractor , and what your options are .

Also , if you have a local news investigative team , give them a call .

They would/should be interested in a story ,if the contractor is taking money and stiffing people .

**A: if they can't provide you wiht a paid invoice for the AC equipment, then they never bought it.
