Florida - I am a tenant in a home that is currently being renovated. A lead inspection confirmed the presence of hazardous levels of lead paint. My son's blood lead level has increased by 40% since the renovations began. Neither my landlord or the painter(contractor) advised me of the potential dangers. The lead paint was disturbed by dry scraping, contaminating airborne dust and soil. The unsafe practices continue...Who is liable, and under what circumstances? I believe they both had "constructive knowledge" of the presence of lead paint, but could claim that they did not have "actual knowledge."
