In a nutshell:
Entered into contract with contractor to build addition. Fired him because he was taking shortcuts and not building what we wanted. Roof leaked within two months. Had to replace siding and roof. Found out he didn't have a license. His partner had license (but wrong class) and she wasn't on contract. Materials were guaranteed on contract but they downsized windows without authorization. Many instances of poor workmanship and construction defect. Reported them to the Department of Professional and Occupational Regulation (DPOR). "Contractor" was prosecuted. License holder was untouched. We sued only for amount paid, representing ourselves, and lost. Filed notice of intent to appeal.
Framing inspection was denied by first inspector due to insubstantial wiring, and inability to view framing. Second inspector came out 2 or 3 days later, passed everything without inspection and no changes had been made. The judge in the first case said we needed a witness to prove that the "contractor" built the roof improperly and that's why it leaked. I don't understand because there was no roof to leak before the "contractor" built it. Isn't there something called breach of implied warranty? How do we prove this?
