tile roof problem

we bought a model home in nov '93 and moved in jan '95. 2 years ago we heard dripping in our great room area and stains started appearing on our ceiling. we called the builder and asked who the roofer was who installed our roof or could he send us a new roofer to fix our tile roof. after numerous appointments, the roofer never showed, and we got a roofer through our insurance company which paid to paint and repair our damaged ceilings. we then had a drought for 2 yrs. now it is raining again and we have more leaks. the company repairing our roof told us that we need a new roof. they said the roof was very poorly installed, as paper under tiles is all crumbled and tiles are slipping. we are looking at a lot of money for a tile roof (we have to have tile because of a deed restriction). can you give us any advice.

insurance never covered the roof only the inside damage. we paid the roofer to fix the roof, he said he did, but next major rain was 2 years later and we have leaks again. roofer went out of business but contractor who hired roofer sent out others who said we need a new roof. i know we need to get a new roof, but a tile roof should last longer than ten years, and will cost us anywhere between $20,00 and $25,000 to replace. my question is: do we have a reasonable lawsuit against the builder?

**A: hire a construction defect litigation attorney and ask him/her. It appears that you would have a claim.
