Call Code Enforcement and ask them this question (although the height of the fence seems to have nothing to do with your concern about what is happening between both fences).
Have you simply asked the neighbors if you can remove your fence (on their property) that is in disrepair?

Well the "homeowner" is 102% unapproachable, it will cause a confrontation.

Thanks Gail and homeguru. We have a one shot approach at asking the homeowner. Nothing producive will come of it. We had to seek attorney advice and it goes to the next level (and it will) if we cant work out a solution amongst ourslves. I wish I could delete the original post. This might resurface in Neighbors & Boundaries in a while will all the details repostd.
