Uneven 2nd Floor

Hi, we bought a new house and on the initial inspection we found the 2nd floor level was uneven. We promptly told this to the builder on the closing table to which he happily accepted to fix. He has not fixed the floor yet?

We have found that even the level of the floor in the rest room is un-even by 1/4 to 3/8 inches. The plumber who came told us that we would need to get the entire level fixed.

CAN WE FILE FOR LAWSUIT AND WHATS THE PROCESS INVOLVED. HOW MUCH WOULD IT COST US AND UPTO WHAT AMOUNT $$$ CAN WE FILE?

**A: why did you close without the floor being fixed first? Or a separate signed letter stating the fix via plans and specs from an architect and specifying the date of completion for this fix.
