1099c cancelledstudent loan


undefinedWhat is the name of your state?MI In January 2005, I received a 1099c that says cancelled student loan debt. I provided it to my tax preparer when filing my taxes for 2004. I had laready filed for Chapter 7 bankruptcy, so tax preparer filed the necessary forms. I spoke with IRS representative who believed that I had filed everthing correctly. Bankruptcy is now discharged and student loan company is attempting to garnish wages, bank accounts etc. I inquired about the issuance of the 1099c and they said, "just a formaility under IRC publication 525." I have read the publication and do not understand how they can continue to attempt to collect a cancelled debt. Additionally, they have added thousands for default and collection for the time period while the bankruptcy was pending. Is there anything special about a 1099c for a student loan that I have missed or unaware of? I'd appreciate any responses or ideas on how to handle this situation.

Student loans are generally NOT dischargeable in bankruptcy. Did you have an adversay proceeding on this SL to have it discharged due to hardship ?? Or was it forgiven due to hardship before you filed BK ??
