2003 Refund/BankruptcyWhat is the name of your state? Florida Is my 2003 tax refund protected from creditors? I am in the process of filing chapter 7 but will not have the petition complete and filed before the April 15th dead line for taxes. Any info. would be greatly appreciated. |

| Once you file for bankruptcy, creditor's can't get anything, including your tax refund. However, the Trustee can and likely WILL take the refund even if you haven't filed it before you file for BK. Since you would be expecting a refund when you file for BK, that expected refund is part of your bankruptcy estate, so its fair game for the Trustee.

| Thanks for the info....I'm sending my tax forms in today and I'm also filing my petition with the court today. Your advice is exactly what I figured would happen but I needed to hear it from someone who knows the Bankruptcy Laws better than I do. Thanks again......Kit |
