341 Meeting


What is the name of your state? MA

I had my 341 mtg the other day - Chapter 7, no asset. I was a little nervous since 1st man to go really was getting grilled by trustee (he had a lawyer). My turn came (pro se), he asked the basic questions - had a few questions about things on my papers. Other than showing drivers license and SS card, nothing else - no tax returns, bank statements, pay stubs. Done. Whew! Now, I usually get a tax refund of a couple thousand. Should I hold off and file in March and not right away in early Feb. just so the trustee for some reason won't take it? Let 6 mos. go by? He didn't ask anything about a refund.

This time of year, Trustee's start looking for those expected tax refunds. Don't assume you'll be able to keep it. Definitely file as late as possible, but the Trustee could still go after it.

Just a thought...


Hopefully somone will jump in and confirm this, but...if we're talking about your expected refund from NEXT year...you might want to adjust your withholding (number of exemptions you claim) so that you don't get a refund next year. Once you've had your 341, any increases in take home pay are not usually of concern to the trustee. Put the money in your pocket...or bank...instead of letting the government use it interest free.

I agree with Oglethorpe - adjust your withholding ASAP.
