another 1-2 questions chapter 7


What is the name of your state? ms

have another question or two
when i put on the papers that i want to reaffirm the loans on the house and the trucks, will i be able to? i read somewhere that if i didn't have a lawyer i would have to go to a reaffirmation meeting? also, will it show included in bankruptcy on this loan on ex-fiances credit report? i don't want it to go against him.
also, do you know anything about Sears card. can i show this as a secured card and reaffirm this credit card debt?

As long as your financial status allows you to continue payments, I'm sure you'll be allowed to. Trustees only object, usually, if they think it will be a bad thing do so.

Maybe. I'd have to read up on your states local BK procedures to be certain. 9 times out of 10 all you do is sign the papers and its over.

Again, the answer right now is 'maybe'. The practice of credit bureaus noting 'included in bankruptcy' on the non-filing joint account holders reports is the subject of a huge class-action against all 3 CRA's - and they are supposed to stop doing this. So, it *might* end up there, it might not. If it does, it should be easily removed with a dispute - I think the CRA's will be pretty touchy on that for a long time !

Weeeellll... Sears is one of the very few creditors that always shows up at 341 meetings. They USED to be very aggressive in these meetings pressuring people to sign reaff agreements or turn over the property - sure, they really wanted your used toaster... Anyway, the Feds made them stop that and they are much-tamed these days, but they do still show up. So, I'm sure the Sears guy would be more than happy to have your reaffirmation if you choose to do that.

thank you so very much for your help. you have helped me tremendously. i have been searching the internet for help and finally found this site. i have been so worried about doing this myself but thought what the heck, i'm smart enough to figure this out myself for the most part anyway. just be honest and don't leave anything out!!!! thanks again for your help have a great day
