Is anyone familiar with Adversary complaint in bankruptcyWhat is the name of your state (only U.S. law)? WI Please help. I did not do anything wrong here. A company filed an adversatry complaint, I filed a countercomplaint. This company is why I had gone into bankruptcy. They motioned to dismiss the counterclaim, and never answered the counterclaim but rather filed a brief in lieu, with not responses to the claims. On some of the counterclaims they are stating lack of jurisdiction, yet I was told that the bankruptcy judge would have jurisdiction. Is there a rule, case that would show the jurisdiction? or what would be my grounds in the objection. Do I just state the counterclaims are the reasons for the bankruptcy. Please help. |

| Adversary claims in bankruptcy are among the most complicated legal proactice areas. I wouldn't even attempt to give you any advice except to counsel you strongly to contact your local bar association for a reference to an attorney who specializes in BK litigation. The key word here is litigation. There are literally thousands of lawyers with BK practices, but relatively few with actual BK litigation experience. |
