Attorney's request.....


What is the name of your state? ky

I am to pay my attorney fees to file bk next Monday. The attorney will accept cash only for his fees. Is this the norm? Is it that he cannot accept a bank card or check due to the bk itself?

Not the norm but not unheard of as well.
People with financial problems have been known to bounce checks. He does not want to file, have your check bounce and then be in a sticky spot where he can't collect because you're in bk.
Be sure and get a receipt.

Checks take time to clear. If you're paying and filing at nearly the same time, the attorney's fee check probably won't clear before the bankruptcy is filed. Then you have a problem.

As a general rule, we don't take credit card payments from the debtor. I don't believe it is ethical to charge up a credit card you plan to discharge anyway, and besides, you may face an objection to discharge if you charge your attorney's fees. However, we do accept credit card payments from other sources (like a family member--we simply disclose the source of payment).

Cash solves those problems, and it's cheaper than a cashier's check. So we'll take cash all day long.
