When I was divorced back in 1990, I was in the Navy, and had three kids. My laywer fell on his face and I got a judgement to pay a total of 945.00 per month, when I made only about 1200 per month. That was the law in california when the judge favored the woman. well as you might think I started falling behind right away. I renegotiated years later,with the court in georgia to pay 250.00 a month, which is 100.00 towards back support and 150.00 for my son. The problem is that Georgia gives my Ex food stamps or somwthing and they tack that on to the back support i owe, That has made the back support total 25,000.00. I don't see a way out of this. I owe the IRS about 1200, I have been paying them for the last three years, I am not now married, I am now unemployed and a full time student. I recieved a letter that the Georgia department of human Resources is going to garnish my unemployment checks. I get 298.00 per week, and they are garnishing 258.33 per month. Now, I planned on continuihng to send support anyway out of my unemployment,and even made them awar of this in a letter, I had even paid marches cupport a month in advance. I am current with the court order as of today. but If a bankruptcy, chapter 7, will let me get relief from that debt, 5k in credit card debt and let me keep a 1998 ram truck I have been paying on for two years, and not make me ineligible for student loans I need to know. I dont know where to turn as it is my bills exced my unemployment, and If I get a job, I am not eligible for school loans/grants.I am pursuing a masters in a Physcian Assistant program, and if I can just get through that for the next 26 months, I will be ok. Let me know any wisdom in this area. I am in Texas, and the Divorce decree was domesticated in georgia (Savannah) where my ex lives. I wont be able to afford to go bacvk to court for a modification until I am out of school, by then the "Back" support could be well over 50,000....and that's not fair. She should bear responsibility to stay off welfare and work, My son is 13, so she does not have to baby sit him. The sad thing is she violated our agreement by dispariging me in front of him, so he wont write, and I still dont have an address or current phone, yet I get the shaft!

If they originally set the support amount incorrectly, you can argue that you don't really owe back support, since you were overpaying for years. Hire an attorney in GA to help you.

BK generally does not discharge student loans or child support obligations.
