Bankruptcy


What is the name of your state? california
i am a person that survives on social security and ssi. i have found myself in great financial trouble. i can't even afford bankruptcy. does anyone know the code or stature for social security and ssi income being exempt from collection and the procedure that i have to do to clear the matter up with my creditors.
any help will be greatly appreciated.

My response:

Paulette, sweetheart, darling - - you're going to be okay, and no one can touch your Social Security or SSI payments. Simply, social security and supplemental security income benefits (whether paid or payable) are not subject to execution, levy, attachment, garnishment or other legal process; or to the operation of bankruptcy laws [See 42 USCA §§ 407, 1383(d)] AND as long as the U.S. Government deposits the checks DIRECTLY into your bank account, and that you NEVER have more than $2,000.00 in your bank account at any time. Anything over $2,000.00 is subject to "execution, levy, attachment, garnishment".

Now, get some rest.

consurmer bankruptcy


Good Morning IAAL: Thank you very so much for your prompt and invaluable information. You were quite clear about direct deposits of government checks. About 5 months ago i switched from direct deposit to direct mailing to me, out of fear of my bank account being taken. So next month I will reinstate the direct deposit. No problem with $2000 ceiling.
Should I write to all my creditors to inform them of my situation, ie: exempt income? If so should I sent them certifited mail?
This site and your help is a God sent.
