Bankruptcy 7 Want to dismiss


Hi I live in Ohio. My house is up for foreclosure. I have a buyer that is willing to buy the house. The sheriff sale was scheduled on March 8th. I filed a rushed voluntary petition chapter 7 bankruptcy with a lawpack and the clerks help on the 8th to stop the sale and buy time for my buyer to secure financing. The only creditor I listed was the bank. My buyer now has the financing. I have equity in the home and want to now stop the bankruptcy. How can I get it dismissed or is this fraud? Will I receive my equity out of the sale?

Go to the clerk that helped before and ask for the forms to dismiss the bk. You can do so but, you can't refile for 180 days.

Here's the bad news.....

The fact that you filed bankruptcy will now appear n your credit report for 10 years, regardless of what you do at this point. If you eventually file again, you will have 2 bankruptcies on your report. In other words, it doesn't matter that you don't go through with the case... you have now filed bankruptcy, and that's all creditors will care about.

Also, your report will show that you dismissed the case, which will scare the heck out of any potential creditors for a long time. Since you've showed an intention to file, few creditors will lend you money, since you might file again at any time.
