Bankruptcy Before Or After Divorce??I live in Florida and I am going thru a divorce. Also I am debt very far and I am wanting to claim Bankruptcy. The credit cards are in My name and not my husbands. I don't want to include my husband in the bankruptcy. My husband is hard and heavy on me not to file bankruptcy before we get divorced. My question is**************..does it matter if I file bankruptcy before or after I get a divorce? I just want to know is it a benefit to him if I wait or a benefit to me or neither? I don't want to get screwed and I don't want to screw my husband either. Any advice would greatly be appreciated. Thanks, P.... |

| Legally, you can go either way. In a practical way, though, it's "cleaner" to wait till after the divorce to file. If you're not in a big, hot rush to file, I would suggest you wait till after the BK. You'll have a better idea of what your debts are at that time, and you won't have to deal with your ex in the bankruptcy proceedings if it's after the divorce. Hope this helps! |
