Bankruptcy ch7.... selling house before ch7 discharge?


What is the name of your state?Florida....

If you filed ch7 on March 19,04 Orlando Florida... and your 341 meeting was on april 26, 04... the trusstee contested some items on schedule c to be undervalued.... you responded on June 1,04... creditors have until June 27,04 to contest... when can I expect a discharge, because I want to sell my house (exempt) asap?? Can I sell before discharge??

Rule 4003(b) gives any "party in interest" until 30 days after the 341 meeting to file an objection to a claimed exemption. Once that date passes, I think most bankruptcy attorneys would feel comfortable letting their debtor/client sell property claimed as exempt. A prudent buyer's counsel would, however, probably want a more solid indication of authority to sell, so a Rule 6004 notice of sale might be appropriate.
