I was curious to see how often this happens. I have recently filed Chapter 7. I was worried because I have some things that I'm not sure if they would invalidate my claim. One is that I took out a credit card in December and made a charge on it in January and haven't been able to make any payments since. Second is that the majority of my credit cards haven't been paid in over 4 or 5 months. Third is that my monthly take home is 1600 and my bills are 1650. Fourth is that I have over 16000 in debt and almost no personal property. Maybe 4000 at most. Do I run any risk of having this denied? How often are bankruptcies denied?

Exclamation

IT WILL LOOK STRANGE THAT YOU FILED FOR BK AND THEN GOT A CREDIT CARD AND CHARGED ON IT. BE HONEST WITH YOUR LAWYER AND THE COURT. ALSO, PLEASE BE AWARE THAT THERE ARE NEW BANKRUPTCY LAWS. THIS MEANS THAT THEY WILL GIVE YOU A MEANS TEST TO SEE IF YOU ARE ABLE TO PAY BACK THE BILLS OVER AND EXTENDED AMOUNT OF TIME. THE DAYS OF COMPLETE BK SEEM TO BE OVER. YOU CAN THANK THE CREDIT CARD INDUSTRY FOR THAT. I WAS ABLE TO GET IN UNDER THE WIRE ON MINE BUT I WAS LEFT WITH 53,000 DOLLARS OF DEBT BECAUSE OF A SPOUSE WHO LOVED TO SAY CHARGE IT.
quote:
Originally posted by Curious in California:

Just wanted to clarify. The credit card was taken out and charged on prior to filing. The charge was made mid January and I just filed on March 29th. Just in case that makes any difference or improves my case at all.
