Bankruptcy discharged and now can't make house paymentsWhat is the name of your state? FL Husband and I filed Chapter 7 and it was discharged in Sept. 2003. We kept making payments on the home but did not reaffirm. We find ourselves not able to continue the payments. We have moved in with one of the kids. What will happen to the house. Will the bank just send a deed for us to sign and that will be all since the house was included on Schedule D secured debts and not reaffirmed. |

| The bank will foreclose on the house in the usual procedures. You'll probably get a notice of an auction at some point. However, since you did NOT reaffirm, you cannot be held liable for any deficiency that results from the sale of the property, the bank cannot touch you.
