Bankruptcy I Didn't File What is the name of your state? Georgia
I applied for a loan recently and was told I was denied due to the fact that there was a bankruptcy showing on my credit report filed in 2000. The finance company gave me the copy of the credit report, and I started investigating. It only showed the chapter of bankruptcy, the date it had been filed, the docket number, that it had been dimissed, and that it had been filed as joint. I had filed for bankruptcy in 1998 and it had been discarged in 2000, but that is it. I called an automated phone line that the state if Georgia has for people to be able to check their bankruptcy cases, and sure enough, this case was listed along with my real case. The lawyer listed as the lawyer we had filed with in this fake 2000 case is a lawyer we had consulted with in 2000 about possibly filing again when our car had been repossessed, but he had advised us against filing and told us to contact the bank we had the car note with and try to work it out, which we did. I find it strange that this same lawyer is listed as the lawyer who filed this bogus Ch. 13 for us. lso, I have checked the National Data Center's Web Site and it shows all this info where we had supposedly paid over $1,400 into this bankruptcy plan before it was closed, prt of it through payroll deduction (and I have never had my pay deducted, even during our real bankruptcy!) What recourse do I now have and how can I disprove that we never filed this Ch. 13?What is the name of your state? |
