Bankruptcy info....Help please!


What is the name of your state? California

I'm considering about or in the process to file bankrutcy. Do i really need to hire an attorney? what type of bankruptcy cases should i consider? I don't own anything. All my debts are credit cards bills.
I also owed the Bank some money in my CHECKING ACCOUNT and I heard that if you include that in the bankruptcy, you will not be able to open any checking account with any Bank in the future. Is that true?

it's always best to hire a professional (attorney), but you don't have to.

sounds like chpt 7 might be the route for you based on the limited info you gave.

As for the checking account, once they report you to ChexSystems or Telecheck, filing for bankruptcy means nothing as far as a checking account is concerned. Even if you didn't file for bK, you would have a VERY hard time finding a bank that doesn't use one or the other.

If the Bank already reported to the Chexsystem or Telecheck, will they take my name off the Chexsystem If I pay them back the money that I owed.

I can only give you a qualified MAYBE on that. Certainly if you pay the bank, that'll make them happy, but entries on Chex are kept for 5 years. Write the bank a letter, offer to pay in full and request that they also remove the entry from ChexSystems or Telecheck. You might have some succces, a few people have.

In reguards to the bank thing. I can tell you that once you are reported to chex systems it stays on your record for 7 years. And even if you pay them back you still stay on their system. I know this much becuase I work for a Bank and thats how we do it. Other states or systems may work differently. But my best suggestion would be to pay that asap. Chexsystems is a CRA and must furnish you a credit report. Chexsystem keeps derogs for 5 years-not 7.

How long does the report stay on file? How do I get it deleted?

Each report submitted to ChexSystems remains on our files for five years, unless the bank or credit union that filed the report requests its removal or ChexSystems becomes obligated to remove it under applicable law. The decision to delete a report is entirely up to each bank or credit union and its individual policies
