Bankruptcy/InheritanceWhat is the name of your state? Kentucky My husband and I filed bankruptcy on 09/27/05. Our discharge of debt is dated 01/20/06. My father passed away on 01/30/06. I will inherit a large sum of money. There is a law that I am not sure about. Something about 180 days must pass before I receive or entitled to. If it is received then it will be more than 180 days, but if entitled to, was I entitled to it the day my father passed away? If I tell my bankruptcy lawyer is he obligated to tell the bankruptcy court? ![]() |

| Within 180 days of the petition date, 11 U.S.C. §541(a)(5) includes as property of the bankruptcy estate any property you acquire, or become entitled to acquire, as a result of a gift, inheritance, or devise. You need to consult with both your father's probate attorney and your bankruptcy attorney. You may or may not have an issue. |
