Bankruptcy & Mortgage


What is the name of your state California

My mortgage was included in my bankruptcy and my credit report shows the discharged Debt included in or discharged through Bankruptcy Chapter 7, 11, or 13.

What does that mean? Are they going to kick us out?

We owe about $100,000 more than it’s worth. We are planning to move out of state very soon. So we need to do do a short sale? Can we just walk away?
I can't seem to find any information that addresses this issue clearly
ur state (only U.S. law)?

Did you sign a reaffirmation agreement?
If you didn't, just walk away. You are not liable for any deficiency balance.

No, we did not sign a re-affermation agreement. They wanted us to, but we didn't.

So we really don't have to do a short sale so they won't forclose?
And they won't kick us out? I know we can't live her for nothing forever, but
I just wanted some idea of what's going to happen.

Once you default, your lender will be rquired to follow whatever procedure state law in Ca. mandates to proceed with foreclosure and eventually eviction. Prehaps call the lawyer that handled your bk and ask about a timeline.
You have no obligation to do a short sale or anything else.

be careful, though, because one day while your down at the local diner eating some cake the bank will send someone over to change your locks.

Besides being highly illegal, this post is as stupid as your other moronic posts. I would suggest stepping away from the computer before you show everyone here you are a total idiot and not just stupid. The bank will have to follow the state laws for eviction just like any other property owner.
