Question

Bankruptcy over, loan co. refuses to take auto or give us title


What is the name of your state?Pennsylvania

We filed a personal bankruptcy last year and it was discharged in November, 2004. Our auto was part of the bankruptcy. The auto loan company threatened with many letters before the bankruptcy to reposses the car, but never did. They have now know our address for the last 2 1/2 years, but still they never came for it. The car runs really well. It does need some brake work, interior cleanup, exterior dent and scratch repair. It is probably worth around $4,000.

We have spoken to them on the phone about the car. They told us it wasn't worth picking up and they had no intention anymore to reposses it. They said it was ours and we could do whatever we want with it. However, they refuse to give us the title. We want to get the car title from them so we can get plates, etc. and use the car.

They don't want it, but they refuse to give us the title unless we pay the loan. But the loan was written off in the bankruptcy! We no longer owe the money on the loan.

Is there anyway possible to get the title? It makes no sense to us to have a perfectly good, usable car sitting in our driveway that we can't use, yet the loan company won't come and get it.

We want the title to this car. How do we get it?

Well, you can make a lowball offer to buy it and get the title or, drive it their lot and toss the keys on the desk.
