Bankruptcy questions


What is the name of your state (only U.S. law)? MI

I am really struggling paying my bills in addition to living expenses, to the amount of around $2000 short each month due to periodic layoffs at place of employment. I am about 1 month behind on all my bills and being hit with late fees and also over limit on credit cards from the late fee's being added. I called the CC companies and they are not willing to help, 1 even raised my interest rate 10% for only late payment. So my questions are:

1. If I file and am approved can I keep my house and car?

2. How long before I can apply for a home loan? I live in an area that is getting worse each day and I am not sure how long I can keep living here.

3. Are there any options besides bankruptcy?

You can keep secured assets like a home or car as long the equity is below your state exemption level and you stay current.
With 2 years of clean credit post bk, you can qualify for FHA loans. In 3 or 4 years, you would qualify for conventional loans.

As to other options-nobody knows your financial/employment situation better than you. How much debt do you wish to discharge and what is your income and family size are 2 important questions?
One thing I always suggest is, be sure you can support yourself post bk. If you stopped paying all debt you wish to discharge, could you meet basic living expenses? Does your job offer health insurance? You don't want to file bk and then 6 months later have an accident or illness and be on the hook for large medical debt and you've already played the bk card.
