| A divorce decree cannot dismiss any debts. And depending on the statute of limitations for your state, the debt may be valid. If it is the original creditor collecting the debt, the clock started ticking when the vehicle was resold. If it is another company collecting the debt, the SOL started when they received the debt and began their collection action. I have noticed a pattern when it comes to debt collection by a lot of creditors, let the debt set for a few years and build up interest and late charges then just before the SOL is about to expire, start the collection action in earnest. You may wish to have a consultation with a local attorney that is familiar with the laws of your state.
