bankruptcy and tax refund


What is the name of your state?Pa
My husband and I filed chapter 7 no asset on 9-26. Our 341 meeting is Dec.16
Can the trustee take our income tax refund we are to receive in 2006

This late in the year, there is a real possibility that some part of your refund will be considered property of the bk estate.

we filed chapt 13 on july 15th and had our 341 meeting already and the attys paralegal put down on our finance paper 500.00 for future income refund. i asked her what that meant she said that if nothing was put down then we would lose our whole income tax.. hope that helps..
