quote:
Originally posted by fuscucla1: My sisters boyfriend, Jim, had his former employer go into his personal file and use his information to apply for a credit card. All of the information on the application is Jims except for the mailing address, thats the employers home address. He also faked a signature at the bottom, but its not anything similar to Jim's real signature. The employer then went on to charge 40,000 dollars on the card and never paid it. Its been in collections for years. Jim became aware when the collection agencies contacted him. We have a copy of the credit application (with the fake signature), we have plenty of documents with his real signature, but no one cares. He has been turned down for auto loans because this appears on his credit report, he has been embarassed many times. Our main concern is how do we get it off his record, but I will take advice on what to do with the ex-employer as well. Thanks in advance.

My response:
You have a great Civil case for "theft of identity" among other causes of action - - the least of which are also criminal in nature. See an attorney immediately.
