Ventura, CA.

TIMELINE:

9/98
AVCO Finances Inc.
Upland CA.
(Defaulted account)
Finance manger and I have a written agreement for $200.00 a month till account is paid off in twelve years.
Start balance $29,148.45
Made monthly payments of $200.00 up to 5/99.
End Balance $27,048.45


6/99
Commercial Credit Corp.
Upland Ca. (same address of AVCO)
With no warning or documentation, I get harassing calls from Commercial Credit Corp. Before I even get to send payment. They tell me I owe back payment and must send $600.00 immediately! I proceed to ask them who they are and what account are they talking about??
They say “we are part of AVCO and have taken over the account”.
I proceed to inform them, I have a written agreement with AVCO manager to pay $200.00 monthly till account is satisfied.
CCC proceeds to tell me, “they now have the account and that they want $250.00 and that I am late on my payments?
I inform them I have carbon copies of all my checks made out to AVCO and that I am current. NOTE: I never received any correspondence or memo stating that CCC was taking over account.

Start balance $27,594.45.

I make two payments of $200.00.

7/00

At about 8/00, I get another call from CCC, stating that Citifinancial is now taking over account, to make checks payable to them. I make three on-time payments. I ask CCC manager “what’s going on here?” He states, “don’t worry, just make them payable to Citifinancial”.

10/00
NOTE: Even though I made five on-time payments to CCC/Citifinancial, my account has not changed and they mark off “interest charges”.

End balance shows $27,594.37. (no change!)


11/00
Citifinancial
Ventura CA.
I get a memo from Citifinancial, stating they have moved my account to Ventura CA. The start date for my payments is 1/23/00.
On 1/10/00 I get a payment booklet, monthly payments at $200.00.
On the top right corner it states “Total payments 215”.
I have been on-time with this payment plan as of this writing.

Start balance $27,555.15
Current balance

QUESTION ONE
What recourse do I have with CCC and Citifinancial having the same start balance as AVCO, notice they both are above what AVCO last stated in their receipt to me.
Every time they “move’ my account it goes up about $500.00!
That's a lot for "handling fees" (chuckle)
I thought finance people where good with numbers? (chuckle)

QUESTION TWO
What recourse do I have about CCC not applying my payments to the account? AVCO did, why not CCC?
No wonder these finance companys are sooooo rich, they pocket it? (chuckle)

QUESTION THREE
The 215 payments from Citifinancial are very disturbing to me.
How did they come up with that amount? Besides it does not even balance with AVCO or CCC, what gives?
I did not renegotiate or sign a contract for those 215 payments.
I don’t believe I am contractually obligated to the 215 payments.
What is your advice?
Should I go in to the Citifinancial office and ask to have the payment plan addressed for those 215 months.

(215 months at 200, I hope It comes with a condo or lexus for that amount?) (chuckle)

I am aware that I am accountable and very willing to pay the amount from Avco’s statements, not the higher accounts from CCC or Citifinancial. What is your advice?

Sorry for the time line, but it helps to understand the whole picture.
