cali joint or not?

What is the name of your state? California

I was recently married and both my husband and myself have debt from before marriage? Can we file our debt together even though some of the debt is only in my husbands name? we do have debt together,but the majority of it is his. I'm filing the bankrptcy myself, so I have everything else done but that.

If you're filing by yourself w/o him, then you cannot list HIS debts on YOUR bankruptcy. Pre-marital debt is considered separate and not 'community debt'. If he wants to dump HIS debt, he'll have to file bankruptcy himself.

You CAN and should include any joint debts incurred AFTER you married, that IS community debt.
