Question




In 1994 I went through a messy and expensive divorce. I was liable for a credit card with a moderate limit of 5,000.00 that I had to let go due to my financial sitution. My last payment/activity to the creditor was in Feb of 1994. After the routine tedious harassment from the creditor and collection agencies; the creditor presumably hired or sold the account to a local attorney in 1999. I was notified and taken to court and a judgment was taken out on me the same year(1999). My questions are; Does the original bad debt with the creditor come off my credit history in 2001? My other question is; Will the judgment continue to show up on my credit history from the year 1999 to 2009 or however the length of the judgment? By law, When should the judgment be deleted from my credit file? Under the fair credit reporting act section 605; Can the judgment be challenged to come off my credit file in 2001? Please answer; I live in Texas.

I know with loans, once purchased in a consolidation situation, the credit report shows it as paid. So, it might be the same in your situation where you would then only have the judgment by the attorney.

It may be an issue of how long each credit reporting agency keeps it on file. It may depend on statutory state law or on the fair credit reporting act.

The Fair Credit Reporting Act (FCRA) requires that most negative credit items be deleted from your credit bureau file after seven years. Exceptions include bankruptcy, which can be reported for up to ten years. The credit grantor or credit bureau have the right to remove negative credit information whenever they please. Inquiries usually remain in your credit file for 24 months.
