Can I file if I may have an upcoming lawsuit?


We're in Ohio. Our house is under foreclosure and we have several judgments which are now beginning to take action (garnishments,etc) just received a summons an hour ago for attorney fees for a probate case we've been in for 8 years and he has not properly take care of. My husband was charged criminally (in the probate case) and was recently acquitted but they filed an appeal to Supreme court. Our criminal atty. told us we would have a case against the court to get back our attorney fees, money spent on court, money lost, personal damages, liens placed on our home, etc. Can we file for bankruptcy while we may have a future lawsuit? We're pretty much totally freaked out right now. We have spent so much money on attorney fees that we are trying to find an attorney who can handle our case for little or no money up front, and get paid on contingency fees for the lawsuit. But we need bankruptcy help now. Any suggestions?

Any potential claim that arose within 180 days of filing bk will become the property of the bk estate.
You need to tell your bk lawyer about the possible lawsuit.
