Our car was repossessed on 7/20/00. We tried to negotiate payment terms because my husband had just started a new job. He had been unemployed for a few months. That is why we got behind on the payments and why we were unable to reinstate within the allotted 15 day time span. The finance company was unwilling to negotiate any other terms.

Having done some research into the law on repossession, I find that the company has failed to notify us of when the car has been scheduled for auction. We found out about one time it would be auctioned purely through chance. I called the company listed on the paperwork we received from the finance company after the repossession. Also, on 10/20/00, the car will have been repossessed 90 days. According to the law I have read, we should be able to recover in conversion. This is from section 12A:9-505 from the Permanent Statutes of both New Jersey and Maryland. The car was purchased in New Jersey and repossessed in Maryland.

Two questions:
What are our rights in regards to the fact the finance company has not notified us of the time and place of the auction of the car? We suspect that they have been trying to auction it all this time.

What exactly does it mean to recover in conversion?
