Ch. 7 and timing on filing.


What is the name of your state? Utah

I've been doing some research on cccs vs. bk ch7, etc. or just continuing with things the way they are. We owe about 21k total between 3 cc, which are in my name, I'm an at home mom, and I was wondering on the timing of filing with regards to a few recent (2 wks ago) purchases on a cc (kids school clothes totalling maybe $200-300). I worry about those charges appearing fraudulant if I file. What is the time period that I need to wait before filing after recent charges, or is there a limit that if it's under thay don't look at? Also, with regards to next years tax return, if I filed now or in Nov. would that be something the trustee would be able to keep? Not that I'd mind, I just want to have all the facts so I can understand.

I wouldn't worry about the recent charges since they were for a small amount and it wasn't a cash transfer.

As for your tax return, you can probably forget getting to keep it if you file this time of the year. Although, if it's not a large amount your trustee may abandon any claim to it. You would do well to change the amount of taxes withheld from any paychecks so that your refund would be smaller if you plan on filing.

I would guess our return to be 1200 fed & 800 state, based on last year's return. Do you think that is likely to go straight to the trustee?

oh, also... I think I will file by myself, without my dh & since I don't have any income, would the trustee still take it? It really wouldn't matter, it would just be nice to know & plan on either way.

I wouldn't do the CCCS... I've heard a LOT of bad things about them... Had a friend who did it and screwed up his credit even more... Look and think very closely before you follow that route...
