CH7 BK and Prior Judgements


What is the name of your state? Oregon
Hello. I filed Ch7 in October of 1997. At the time, I had a newer mobile home that I planned on keeping, but was unable to make the payments, due to other financial circumstances. The finance company got a judgement against me 1 week prior to me filing my Ch7, and I was unaware of the judgement. There was also another judgment in April of that same year that I was unaware of.
Since I didn't know about the existing judgements, they were not included in my Ch7, and now almost 7 years later the 2 judgements are still on my credit report and the finance company also lists a debt of nearly $14k (the delta of the selling price of the home and what I owed). Does my Ch7 include these and can I get them removed from my credit report or at least reported discharged through my Ch7?

Did you have the underlying debt included in the Chapter 7?

I don't know exactly what you asked me. The home was listed on my Summary of Schedules as a liability. I had planned on keeping the home, but they repossessed it prior to my discharge. It's also listed on my Schedule D Creditors Holding Secured Claims.

I'm saying if you included those creditors in your bk filing, you and your lawyer can return to the court that issued the judgment and petition to have it vacated.
