CH7 and errors I can't get removed from Credit BureausWhat is the name of your state (only U.S. law)? TX I filed for a personal as well as a business CH7 in May '08. I received my personal discharge in Aug '08. The business had no assets. About 2 months ago, a collection agency puts 9 collection accounts from my businesses credit card processor on my personal report. I filed a dispute claim with the credit bureau, claiming the following, 1. The collection accounts were opened 6 months AFTER my discharge, 2. The accounts were business accounts, and not mine personally, (business was a Sub.Ch. S corp.). My claim was rejected because they said the accounts transferred to me because I had a personal liability. Not sure if that statement is correct, BUT my question is, "Isn't it illegal to pursue a debt that has been discharged?" and "What legal recourse do I have?" Thanks |

GaAttyIt is unclear from what you have said whether or not you filed a personal Ch. 7 and an additional business Ch. 7. If you filed a personal Ch. 7, these debts should have been listed. If you did not list them, you can (with some costs) possibly re-open the bankruptcy and add these creditors. |

More infoI filed both a personal and a corporate CH7. These creditors were listed on both, just in case. It appears that the credit card processor might have sold the debt to the collection agency, because the open debts shown by the credit bureau are after my (personal), discharge. Even the credit bureau report shows the debts were discharged in the 7. My question is, is it legal to list these showing open dates after the discharge? Wouldn't that be a violation of attempting to pursue a debt that has been discharged? |
