Chap 7What is the name of your state? Pennsylvania Ok, I'll try this again. I already asked if my mother would be obligated to pay a loan that she co-signed for me if I file Chap. 7. If I don't include that loan in the bankruptcy filing would they go after her in any way? I would like to omit my car loan and the mortgage loan (that my mother co-signed for) from this filing. Can I omit these two and where would that leave my mother with my obligations? Also, can I include cash advances in the chap 7? Thanks again. Last edited by chelsey1; 04-05-2003 at 03:11 PM. |

| Sure. You can leave those off, but intentionally doing so would be in violation of the law. You are required to list every single debt and every single asset in your bankruptcy petition, under the penalties for perjury that they are accurately and completed listed. And you would be asked verbally, under oath, at your meeting of creditors if you had listed all your debts and assets. Your proposed solution to your problem is not a good one. |
