Chapter 13What is the name of your state? VA My sister has a judgement for $17k against an individual and now this person has filed for bankruptcy. How does this affect the judgement my sister has against her? That is, can this person list my sister as a creditor inorder not to to pay the judgement? If she does, will my sister have any recourse to collect the money owed? Can the court allow the dismissal of some judgements and not others or do they usual grant for everything that is listed in the documents? Will my sister, after so many years, be able to get another judgement against this person? Thank you! |

| If the judgment debtor HAS filed CH 13, the judgment gets included, and your sister should get some percentage of it paid to her thru the BK court. A lot depends on how much of the Plan allows for repayment of unsecured debts. She may not get the full 17K.
