Question

chapter 13 bankruptcy

What is the name of your state? ia what happens if you've filed chapter 13 almost a year ago, the payments are too much to handle anymore, you owe a large sum of income taxes, let the house go back and hardly have anything left to live on. if i stop paying it what will happen and can i file chapter 7?

If you just stop paying, your CH 13 will be dismissed and all your creditors will come back after you with a vengeance - you don't want that.

What you CAN do is CONVERT your 13 to a Ch 7. This takes filing some more forms with the court. Ask your lawyer, he/she can do this easily - happens all the time.
