Chapter 13 help! Please!


What is the name of your state? Georgia

I went to an attorney and filed but now cant seem to get anyone at their firm on the phone and I am getting desperate! I have tried for 3 weeks by phone (several times a day) and fax but nothing so if anyone here can help...

I keep getting phone calls harrassing me both home AND work and they are threatening to garnish my wages and repossess my car! Without my car I cant get the 35 miles each way, a day to work! Can they do that? Can the Student Loan people still garnish my wages? I got in this because I have a heart condition and the stress has put me into the hospital once last week and I will be in there agin if something doesn't give soon!

HELP!?!

NO, they absolutely CANNOT harrass you it violates the automatic stay that went into place when you filed for BK.

If you have a BK case number, then tell the collectors that you have filed for bankruptcy, give them the case number and the name, address and phone number of your attorney - then HANG UP ON THEM ! You are in no way obligated to speak to them and upset yourself. Their harrassment is ILLEGAL and there is NOTHING they can do to you - can't take your car, can't garnish your wages, NOTHING ! You can also tell them that if they do NOT stop harrassing you and contact your lawyer as they are supposed to do that you will file a motion for contempt against them for violating the automatic stay and you'll demand sanctions and damages - their illegal actions are directly endangering your health !

If you cannot get your attorney on the phone, the I'd go to their offices and park my butt in their offices and demand they do their job in stopping the creditor calls and in answering your questions. YOU are paying THEM to do a job - and you can fire them for it if they don't.
