Question

chapter 13 joint tenant in common

What is the name of your state? florida

I am in process of filing chapter 13. I am a joint tenant in common on an undeveloped lot that has some equity. Will I be allowed to maintain that equity if the other party continues payment? Can the trustee sell my portion to the "highest bidder"?

**A: are you a joint tenant ot a tenant in common? Either way, you may still be affected.

**A: it would be up to the BK Trustee.

Can the trustee sell my portion to the "highest bidder"?

**A: yes and even order the entire property sold.

Thank you for your reply. It is joint tenant in common with rights of survivorship.

How can BK trustee order the entire property sold? The other party is not a blood relation, nor spouse.

If I didn't file for now, and sold my interest, and paid on bills with the money, would this cause a problem with the Chapter 13/trustee.
