Chapter 13 and Life InsuranceWhat is the name of your state? Indiana My husband and I filed a Chapter 13. He has recently died and I will probably be unable to meet the required payment on my income alone. Can the court decide to use any of the life insurance payment I will receive to help with the payment that was originally set up? If I change to a Chapter 7 will the life insurance payment have to go to that? |

| Probably not, but you need to read the policy. If the policy clearly states that the payout can NOT be used to pay debts of the deceased, then its probably safe. You have a lawyer, have you asked him/her ??
