chapter 7


What is the name of your state? new york
here are several questions because i am told a summons has been issued by one creditor so far.
1. on form III schedules d.e & f.....
are my credit cards unsecured non-priority claim?
do i list myoutstanding student loan as an unsecured priority?
2. what is the difference between contingent,unliquidated and disputed?

1 - credit cards are Unsecured Nonpriority Claims and go on Sched F.

Student Loans are also placed on Sched F, it doesn't matter that its not dischargeable.

2 - Contingent - claim depends on some event that hasn't yet occurred and may never occur ie. if you were a co-signer on a loan, you would be liable IF the other signer defaulted

Unliquidated - a debt that may exist, but the exact amount hasn't been determined.

Disputed - a claim is disputed if you and the creditor do not agree about the existence or amount of the debt.

chapter 7---schedule f


thanks for your help. schedule f is driving me nuts. the form just doesn't provide enough space to type in the original creditor and then the collection agency and all the required info,acct # address,etc. really not sure what to do...if i place the original creditor's acct# address and so on in the box on the first line,can i simply write "see box below" in boxes asking for date of claim and amount, and then in the next line write in the collection agency, the date they took over and the amount? i can't even tell if i am asking this question clearly enough...sorry.

You may want to double-check to be sure, but student loans are normally listed in Schedule E as an unsecured priority debt. The box that references debts owed to governmental units (next to last) should be X'd.
