Chapter 7

What is the name of your state? Indiana

If someone files for Chapter 7 does that mean that the debts will automatically get discharged or is it up to the judge to decide which debts will?

**A: it is up to the Trustee. And not all debts get discharged.

99.99% are discharged. You have to check your state of exclusions. Student loans, fraud, fines, dui damages are some that most states exclude.

**A: the writer did not specify what type of debts. Are you implying that 99.9% of debt in a BK 7 is discharged, even child support payments and all secured debt?
