chapter 7 bakruptcy


What is the name of your state? new york
question #3 of the statement of financial affairs it asks all payments made within 90 days preceding commencement of this case. i havent paid anything other than my rent,car payment and car insurance for 4 or 5 months. also alot of my debts have now gone to collection agencies. do i list them or the original creditor?

What the form says is " list all payments on loans, installment purchases of goods or services, and other debts AGGREGATING more than $600 to any creditor, made within 90 days immediately preceding the commencement of this case."

So, unless you've paid any ONE creditor a TOTAL in payments of $600 or more, you must list those payments on ? 3, and list the dates of those payments and to whom.

What's the total of your car payments over the last 3 months ? Is it $600 or more ??

Your rent is not a debt, its a normal expense. So is car insurance.

If you've paid any of the collection agencies or creditors a TOTAL of $600 or more in the last 90 days -- same thing.
