My husband and I are considering bankruptcy, a chapter 7 in Delaware. We are aprox $30,000 in debt. Most is medical bills but then we have judgements, credit cards and utility bills. We currently have an electric bill that is in excess of 1500.00 If we clam this debt, can it be discharged and will we be able to start a new account. We also owe 2000.00 on our minivan through a second chance finance. We are current on our payments now so will we be able to keep it? Thanks for any help.

You need to see a lawyer about exemptions in Delaware. Most will give a free initial consultation. As to the power bill. Yes, it can be discharged and you can get a new account but, be prepared for a higher deposit.

Utility bill


You may need to talk to your utility company first before you do anything. I do know that in Ohio, where we live, before we filed Chapt. 7, our utility bill was up to 1500.00. They erased everything that was prior to our filing, we did have to sign on with them again and make a 200.00 deposit, but that was not a problem. Also, our company did not shut us off at all when we didn't pay. So hopefully you will not have any problem with your company. Good Luck, hope this helps.
