Question

Chapter 7 and income tax refund

What is the name of your state? TX.

My 341 is this Friday ( chapter 7) and I am stressed out about them taking my tax refund. I am not expecting much back, but we need it to relocate for my husband job.We have no tfiled yet, but I did my own calculations and if we dont get it, it may put us even more behind. Will the refund be taken?

I'm surprised that the Trustee has not already sent you a letter telling you that you must file your tax return by a given date. He may do so at the 341 meeting. If you're going to get a big refund, kiss it goodbye, the Trustee will take it. If its only a small refund, the Trustee may let you keep it.

What about your lawyer ?? It MAY be possible to exempt the refund so you can keep it, so you'd better ask that before Friday !
