Chapter13 Nightmare


What is the name of your state?Ohio.... My chapter13 was final on Dec 18,2005. This has been going on for 3 years. My original lawyer went in the hospital in October 2005. He had me sign my case over to anther lawyer.
My original settalment $116.00 per week. Now it's $308.00 per week. This new lawyer did nothing for me. What can I do? Please someone tell me what to do

Your post is confusing. What do you mean it's been going on for 3 years and is now final but, the payment has increased?

My orig lawyer keeped refiling from Chapter7 to Chapter13 due to the IRS and the house my family and I are living in. The IRS put an lean on my org house and we could not purchase an other house. So my 18 year old son was able to purchase a house in his name. The IRS was tryng to go after my sons house, so my orig lawyer was tring to prolong the bankruptcy so the IRS could not go after the house. I have been paying $119.00 per week, and thats what my orig lawyer told me it would be. Now with this new lawyer taking over for my orig lawyer went to court and sided with the IRS. he never called me to let me know what was going on or what the IRS wanted in court.
I recieved a notice two weeks ago of the increase.

Well let me ask you this. If Iam not happy with the end results of my case and the court, can I refile chapter7 under the old laws??

If the recent Chapter 13 was filed prior to 10/17, you should be able to convert and be under the old laws.

One more thing. If this would not work in my favor, what luck would I have in a malpractice suite against this second lawyer or my orig lawyer work?
